The Competition Commission of India (CCI) rejected the complaint of Transparent Energy that Tecpro Systems was offering predatory bids for contracts to set up Waste Heat Recovery Power Plants (WHRPP). Transparent Energy had lodged a complaint with CCI that Tecpro Systems continuously won orders from cement companies by quoting abnormally low prices, which cannot be justified as per the standard norms for working out costs in project- related systems like WHRPP. Tecpro entered into an agreement with China-based Nanjing Triumph Kaineng Environment and Energy Company for the supply of boilers, turbine and generators (BTG). After this agreement, Tecpro entered the Indian market to setup Waste Heat Recovery Power Plants in 2011 and owing to its collaboration with the Chinese firm, quoted very low prices in all bids. Transparent Energy further said that Tecpro is a dominant player, holding about 50 per cent of the market in terms of number of projects after its collaboration with the Chinese firm. In its order on June 6, the CCI said that the arguments raised by the applicant (Transparent Energy), that the prices quoted by the opposite party (Tecpro Systems) were unfair or predatory, has no force. It further added that it cannot consider the quotations given by another bidder predatory simply because the bidder got contracts for five projects.
